
Being a law and Constitution student this question always disturbs me that whether GB WhatsApp is safe for both users and non-users of this app?
GB Whatsapp is been used by the majority of the people on the internet as it has extra features over the original app. When the users use in the majority the demand grows for such clone apps and the third-party app developers get motivated to create such apps.
Have you ever thought about what happens if some personal pictures are mistakenly posted in such apps? The fact is even if you delete it on your phone it won’t be deleted from theirs and thus it can be used by them for their benefit. We can’t always assume that the person using the app is a bad person but also we can’t know that the person is good.
What would you do if that image is misused by someone to defame or for sake of money or take advantage of you? What would you do if someone posts that image without your permission? Hence many people are becoming a victim of privacy for such technology.
This directly leads to the violation of the Right to privacy which comes under Part 3 of the Indian Constitution. Part 3 of the Indian Constitution consists fundamental rights of the citizens. Article 21 is one of them that is the Right to life and personal liberty.
Right to Privacy is protected as an intrinsic part of the right to life and personal liberty under Article 21 and as a part of freedoms guaranteed by Part lll of the Indian Constitution.
Article 21 states that “No person shall be deprived of his life or personal liberty except according to procedure established by law”.The Supreme Court has implied the right to privacy from Article 21 by interpreting it in conformity with Article 12 of the Universal Declaration on Human Rights and Article 17 of the International Covenant on Civil and Political Rights, 1966. Both of these International documents provide for the Right to privacy.
As there will be a mere possibility of misusing the photographs ,videos which were sent or posted in status mistakenly.So how can you claim control if such action takes place? There are three options for reclaiming control including claiming invasion of privacy, defamation or a breach of your right to privacy.
There is a solution if such bad actions take place. But it’s better to ban such apps so that no one becomes a victim of privacy for such technology. These apps are dangerous to the private life of an individual as he needs to take full precautions to avoid such mistakes. We must be aware of the privacy and security of the apps before using such clone apps it looks exciting but the more exciting it’s riskier to your life sometimes. When the demand will not be there for such apps then there won’t be third-party developers and thus secures the life of an individual (maybe male or female). It’s better to use original apps and stop using such clone apps as privacy and security is everything and it matters a lot for all living organisms.
