I’m a law student and have pursued a 5-year law course. 5 years law students of Karnataka Law University have become victims in the current situation. People say that law students don’t want to study, don’t want to write exams, they are wasting time and destroying their life. But do you know what they are facing? Do you have all information on what is going on at the university administration?
As per the Judgement given on December 14th 2021 in the Karnataka High Court 3 years LL.B students got promoted on the assignment based mode. After that judgement, Karnataka Law University accepted the promotion of 3years LL.B students but the very next day 5yrs B. A LL.B students exam was held without any time extent for study.
University Vice-Chancellor says that if exams are not conducted it will amount to contempt of court as per November’s judgement. But 5 years had already written the assignment and also an internal assessment. Is internal assessment not an exam? According to the bar council of India, an assignment mode exam can also be conducted but this is not at all taken into consideration by the university.
Now here comes the first matter to be highlighted that 3years and 5 years law students both had online classes, under the same lecturer, in the same class for few equal subjects. This means 3years and 5years students are equal. But where is equality? This is clear that there is discrimination made by the University between the students.
As for now, students of 5 years have boycotted the exams due to the injustice that happened to them from the University. Students have become victims and they are fighting for their rights. Is this not right to fight for injustice made? Did people think about injustice happening to KSLU students? Did teachers think about what students are suffering before blaming them?
As Law students, we are first made to know about Fundamental Rights among which Article 14 Right to equality is one of them. Only knowing is enough or implementing would be the first duty of the student? The law school teach us about equality but is it obeying in this case? Only teaching is enough? Teachers teach us equality but when students learn and implement it in their student life they start criticizing.
Article 14 of the Indian Constitution declares that ‘the State shall not deny any person equality before the law or the equal protection of the laws within the territory of India’.The two phrases “equality before the law” and “equal protection of the law” aimed at establishing “equality of status” in the preamble of the Constitution.
Therefore, University had violated Article 14 of the Indian Constitution which leads to the failure of obeying India’s Supreme Law. It would be the duty of Law students to fight for injustice and discrimination made. If law students won’t fight then who would fight for themselves and who would give justice to the people if they entertain the injustice at the very beginning stage in their law learning life. Hence Right to equality is our right.
